1. Acceptance of Terms

By accessing or using the Shivtirth Ayurved website (shivtirthayurved.com), booking an appointment, purchasing products, or using any of our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must discontinue use of our website and services immediately.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Shivtirth Ayurved ("we," "our," or "us"), operated by Dr. Arjun Sawant, located at Shop No. 4, M-4 Building, Parijat CHS, Near Hotel Maratha, Pratiksha Nagar, Sion East, Mumbai — 400022.

2. Description of Services

Shivtirth Ayurved provides the following services through our website and physical clinic:

• Ayurvedic Consultations: Personalised health assessments and treatment plans based on Ayurvedic principles.
• Panchakarma Therapies: Traditional Ayurvedic detoxification and rejuvenation treatments including Vaman, Basti, Nasya, Shirodhara, Katibasti, Pindaswed, Uttarbasti, and other specialised procedures.
• Suvarnaprashan: Ayurvedic immunisation therapy for children, administered on auspicious dates (Pushya Nakshatra).
• Online Prakriti Test: A self-assessment questionnaire to determine your Ayurvedic body constitution (Vata, Pitta, or Kapha).
• Ayurvedic Products: Sale of herbal medicines, supplements, and wellness products through our online shop.
• Health Blog: Educational articles on Ayurveda, wellness, and holistic health.

4. Appointments & Consultations

• Appointments are booked primarily through WhatsApp and are subject to availability at our Mumbai clinic.
• You are expected to provide accurate and complete health information during consultations to ensure safe and effective treatment.
• If you need to cancel or reschedule an appointment, please notify us at least 24 hours in advance via WhatsApp.
• We reserve the right to refuse or discontinue treatment if, in the professional judgement of Dr. Arjun Sawant, the treatment is not suitable for your condition.
• Consultation fees and therapy charges are communicated at the time of booking and are subject to change. Any price changes will not affect existing confirmed bookings.

5. Product Purchases & Returns

5.1 Ordering & Payment

• All product prices displayed on our website are in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.
• We reserve the right to modify product prices at any time without prior notice. Price changes will not affect orders that have already been confirmed and paid for.
• Payment is processed through secure third-party payment gateways. We do not store your full payment card details on our servers.

5.2 Shipping & Delivery

• Delivery timelines are estimates and may vary depending on your location and logistics conditions.
• We are not responsible for delays caused by courier services, natural disasters, or other circumstances beyond our control.

5.3 Returns & Refunds

• Due to the nature of Ayurvedic medicines and health products, returns are accepted only if the product is received in a damaged or defective condition, or if an incorrect product was delivered.
• Return requests must be raised within 7 days of delivery by contacting us via WhatsApp or email with photographs of the product and packaging.
• Refunds, if approved, will be processed within 10–15 business days to the original payment method.
• Opened, used, or partially consumed products are not eligible for return or refund.

6. Intellectual Property

All content on the Shivtirth Ayurved website — including but not limited to text, graphics, logos, images, blog articles, product descriptions, videos, and software — is the exclusive property of Shivtirth Ayurved and is protected under applicable Indian intellectual property laws.

• You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any content from our website without prior written permission.
• Limited, non-commercial use such as sharing our blog articles with proper attribution and a link back to the original page is permitted.
• The "Shivtirth Ayurved" name, logo, and associated branding are trademarks of Shivtirth Ayurved and may not be used without authorisation.

• We are not liable for any health outcomes resulting from Ayurvedic treatments, as individual results depend on numerous factors including but not limited to body constitution, lifestyle, and adherence to prescribed regimens.

You agree to indemnify, defend, and hold harmless Shivtirth Ayurved, Dr. Arjun Sawant, and their employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from:

• Your violation of these Terms
• Your misuse of our website or services
• Your provision of inaccurate health or personal information
• Any third-party claims arising from your use of our services or products

10. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, including but not limited to:

• The Consumer Protection Act, 2019
• The Digital Personal Data Protection Act, 2023

Any disputes arising out of or related to these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.
